Preamble

This treatment agreement governs the rights and obligations of the doctor and the patient within the framework of a telemedicine consultation. The goal of the telemedicine treatment is to provide the patient with medical advice and treatment through digital communication channels.

§ 1 Subject Matter of the Contract

Under the terms of this treatment agreement, the doctor provides private medical services to the patient, including taking a medical history, diagnosis via digital communication channels (e.g., video call, telephone, email), creating a treatment plan, issuing prescriptions for medications, including medical cannabis where medically indicated, and providing advice and information about diagnosis, treatment options, risks, and alternatives.

The patient agrees to provide the doctor with all information relevant to the treatment truthfully and completely. The patient also agrees that in the event of the attending doctor's unavailability, a representative may provide the aforementioned services.

§ 2 Billing and Fees

The telemedicine consultation is a private service and will be billed according to the German Medical Fee Schedule (GOÄ). The fee for the telemedicine consultation is €14.99 and will be offset against the deposit made. Coverage by private health insurance (PKV) or statutory health insurance (GKV) cannot be guaranteed. If coverage is not provided, the costs will be incurred as a self-pay service. The patient will receive an invoice after the consultation, detailing the services provided and the corresponding costs.

§ 3 Use of CannGo Software, Data Protection, Medical Confidentiality

The patient acknowledges that the attending doctor uses the CannGo software to conduct telemedicine treatments and agrees to its use. The doctor commits to treating all personal data of the patient confidentially and using it only within the framework of legal provisions. The patient releases EQUIOM CAPITAL INVEST Sp.zo.o., ul. Wały Piastowskie 1/1508, 80-855 Gdańsk, Poland from medical confidentiality to the extent necessary for fulfilling the contract. This release also applies to subcontractors of EQUIOM CAPITAL INVEST Sp.zo.o., ul. Wały Piastowskie 1/1508, 80-855 Gdańsk, Poland.

EQUIOM CAPITAL INVEST Sp.zo.o. provides the following services for the doctor:

Appointment scheduling and booking
Electronic transmission of qualified electronically signed private prescriptions to pharmacies
Invoice creation
Document storage and management
Patient support before and after consultations

The patient agrees that their data may be electronically stored and processed by EQUIOM CAPITAL INVEST Sp.zo.o. for the purposes of treatment and billing, as a subcontractor of the doctor. The release from medical confidentiality can be revoked at any time in writing by providing the order number to support@canngo.express.

§ 4 Liability

The doctor is liable for damages caused by intentional or grossly negligent behavior but is not liable for damages caused by incomplete or incorrect information provided by the patient. The doctor is not liable for technical issues or failures beyond their control.

§ 5 Duration and Termination of the Contract

The contract begins with the patient's agreement to these terms and ends with the conclusion of the telemedicine consultation. Both parties may terminate the contract at any time for a significant reason. Termination must be made in writing.

§ 6 Final Provisions

Changes and additions to this agreement must be made in writing. If any provision of this agreement is or becomes invalid, the validity of the remaining provisions remains unaffected. The invalid provision is to be replaced by an effective regulation that comes as close as possible to the economic purpose of the invalid provision. The law of the Federal Republic of Germany applies. The place of jurisdiction for all disputes arising from this agreement is the place of the doctor's registered office.
